Before filing any formal dispute, you agree to contact us at contact@heinrichstech.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Florida, and judgment on the award may be entered in any court having jurisdiction.
YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, natural disasters, or government actions.
